Welcome to Taneja School of Music (TSOM) (“TSOM”, “we”, “our”, or “us”). These Terms & Conditions (“Terms”) constitute a legally binding agreement governing your access to and use of our online music education services. By enrolling in any of our programs or using our services, you acknowledge that you have read, understood, and agreed to be bound by these Terms, including any policies referenced herein. Your continued use of our services shall be deemed as acceptance of these Terms in their entirety.

1. NATURE OF SERVICES

Taneja School of Music (TSOM) provides structured and professionally designed online music education programs, including but not limited to guitar, ukulele, and other instrumental training. All sessions are conducted through designated virtual platforms such as Google Meet or other equivalent technologies as determined by us.

We reserve the right to modify, enhance, suspend, or discontinue any aspect of the services, including course structure, delivery format, or platform used, in order to maintain quality standards, adapt to technological advancements, or address operational requirements. Such changes shall not entitle users to any claims or compensation.

2. ELIGIBILITY

Enrollment in our programs is open to individuals who are legally competent to enter into binding agreements under applicable laws. By enrolling, you represent and warrant that all information provided by you is accurate and complete.

In the case of minors, enrollment must be completed by a parent or legal guardian, who shall assume full responsibility for the minor’s participation, supervision, conduct, and adherence to these Terms. The guardian shall also be liable for any obligations, including financial commitments, arising from such enrollment.

3. ENROLLMENT AND CLASS STRUCTURE

Enrollment shall be deemed confirmed only upon successful receipt of full payment of the applicable fees. Each course consists of a predefined number of sessions based on the selected plan, with each session having an approximate duration of 40 minutes, subject to reasonable variations depending on teaching requirements. Class schedules are determined based on mutual availability between the student and instructor; however, we reserve the right to make necessary adjustments in scheduling, instructor assignment, or session structure to maintain academic integrity, ensure consistency in delivery, and address unforeseen circumstances.

4. FEES AND PAYMENT TERMS

All fees must be paid in full and in advance prior to the commencement of the course or billing cycle, unless otherwise agreed in writing. Fees once paid shall be strictly non-transferable and non-adjustable, except where expressly provided under our Refund Policy.

We reserve the right to revise pricing, introduce new fee structures, or modify existing plans at our sole discretion for future enrollments. In the event of non-payment, delayed payment, or breach of agreed payment terms, we reserve the right to suspend or terminate services without prior notice and without any liability.

5. RESCHEDULING, CANCELLATION, AND ATTENDANCE

Requests for rescheduling must be communicated at least 24 hours prior to the scheduled session. Any request made within 24 hours, including those made at the last minute or less than 2 hours prior to the session, shall be subject to our discretion and, in all cases, shall be deemed as conducted and utilized.

We reserve the right to decline repeated or short-notice rescheduling requests in order to maintain scheduling discipline, ensure instructor availability, and uphold the overall learning schedule. While reasonable efforts may be made to accommodate valid requests, no guarantee is provided.

In exceptional or unavoidable circumstances, we may reschedule sessions at our discretion, with reasonable prior notice. However, such adjustments shall not create any entitlement for additional sessions or compensation.

6. CODE OF CONDUCT

Students are expected to maintain a high standard of professionalism, discipline, and respectful behavior during all sessions and interactions. This includes adhering to instructions, maintaining decorum, and engaging constructively in the learning process.

Any conduct deemed inappropriate, including but not limited to disruptive behavior, abusive language, harassment, or non-cooperation, shall not be tolerated. We reserve the right to suspend or terminate access to services immediately in such cases, without any obligation of refund or continuation.

7. TECHNICAL REQUIREMENTS

Students are solely responsible for ensuring access to a stable internet connection, compatible electronic devices, and the necessary musical instruments required for participation. It is the student’s responsibility to ensure that their setup is functional prior to each session.

We shall not be held responsible for any interruptions, delays, or inability to conduct sessions due to technical issues, connectivity failures, or equipment limitations at the student’s end. No compensation, rescheduling, or refund shall be provided for such disruptions.

8. INTELLECTUAL PROPERTY RIGHTS

All content provided by Taneja School of Music (TSOM), including but not limited to teaching materials, lesson plans, methodologies, audio/video content, and proprietary techniques, remains the exclusive intellectual property of TSOM.

Any unauthorized recording, reproduction, distribution, sharing, or commercial use of such content, in whole or in part, is strictly prohibited. Violation of this clause may result in immediate termination of services and initiation of legal proceedings, including claims for damages and injunctive relief.

9. DISCLAIMER OF WARRANTIES

We make no representations or warranties, express or implied, regarding the achievement of any specific learning outcomes, performance levels, or professional advancement. Progress and results are dependent upon the student’s individual effort, consistency, practice, and engagement with the course material.

All services are provided on an “as is” and “as available” basis, without any guarantees of uninterrupted access, accuracy, or suitability for a particular purpose. We expressly disclaim all warranties, including but not limited to merchantability and fitness for a specific objective, to the fullest extent permitted under applicable law.

10. LIMITATION OF LIABILITY

To the fullest extent permitted by law, Taneja School of Music (TSOM) shall not be liable for any direct, indirect, incidental, special, or consequential damages arising out of or in connection with the use of its services. This includes, without limitation, loss of data, loss of opportunity, business interruption, or dissatisfaction with learning outcomes.

In any event, our total aggregate liability, whether arising in contract, tort, negligence, or otherwise, shall be strictly limited to the amount of fees actually paid by the student for the relevant course period giving rise to the claim.

11. TERMINATION

We reserve the right to suspend or terminate a student’s enrollment at our sole discretion in the event of any breach or violation of these Terms. Upon such termination, the student shall not be entitled to any refund, compensation, or continuation of services.

We may also terminate or restrict access without prior notice where necessary to comply with legal obligations, enforce our rights, protect our reputation, or maintain the integrity and safety of our learning environment.

12. AMENDMENTS

We reserve the right to modify, update, or revise these Terms at any time without prior notice. Such changes shall become effective immediately upon being published on our official website or platform.

It is the responsibility of users to review these Terms periodically. Continued use of our services following any such modification shall constitute acceptance of the updated Terms and conditions.

13. GOVERNING LAW AND JURISDICTION

These Terms shall be governed by and construed in accordance with the laws of India. Any disputes, claims, or controversies arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the competent courts located in [New Delhi / Gurugram].

We further reserve the right to enforce these Terms at our sole discretion, including the right to waive or enforce any provision selectively without affecting our ability to enforce the same or other provisions in the future. No failure or delay in enforcement shall constitute a waiver of rights.
